Measure 37 provides that claimants can file a lawsuit in circuit court if restrictive land use regulations continue to apply to their property 180 days after making written demand for compensation. In addition to this new civil cause of action, state law provides that circuit courts may review county decisions through the writ of review process. The writ of review process enables judges to review a county's interpretation of the law, examine the evidence, and issue appropriate relief.
County governments are attempting to prevent claimants from using the writ of review process to appeal denials or unfully conditioned approvals of claims. Marion County Circuit Court recently denied Marion County's attempt to block the writ of review process in our case Marckx v. Marion County.
